Employer Wage Deduction
You, as a debtor, are responsible for making your Chapter 13 Plan payments according to the terms stated in your plan. Whenever possible, your Chapter 13 Bankruptcy Trustee encourages you to make your monthly plan payments using a wage deduction order. Payment through employer deduction helps maintain regular and timely payments. Pursuant to the terms of the Chapter 13 Plan or at the debtor’s request, the bankruptcy court will issue an order to the employer to withhold money from the employee’s paycheck and send it to the trustee. You are responsible for making your plan payment directly to the trustee until the payments are being deducted from your paycheck. If the trustee does not receive your plan payments, the trustee may request that your case dismissed by the Court.
Under Section 2.2 of the Idaho Chapter 13 Plan: Debtor(s) acknowledge that if the debtor(s) is/are ever more than thirty (30) days delinquent on any payment due under this Section 2.1, upon request of the trustee, or request of the debtor(s) at any time, a payroll deduction order to debtor(s)’ employer may immediately be issued.
Online Payment Through Nationwide TFS
For a fee comparable to that of a cashier’s check or money order, a private company–Nationwide TFS–provides the debtor with the ability to make plan payments to the Trustee by electronic withdrawal directly from his or her bank account. Nationwide TFS is a private company that is not affiliated in any way with the trustee’s office. Neither the trustee nor her office shares in any fee paid to Nationwide TFS.
